India Unites in the True Sense

Decisions taken so far

·         Government of India revokes Article 35A along with Article 370.

·         Ladakh to be a Union Territory without Legislature. 

·         Jammu and Kashmir to be separate Union Territory with Legislature. 

·         All provisions of the Indian Constitution as amended time to time will apply to Jammu and Kashmir.

About Article 35A 

·         Introduced in 1954 by then President Rajendra Prasad.

·         Gives J&K the power to decide and qualify its ‘permanent residents’.

·         Prevents the non – residents Jammu & Kashmir people from owning property and availing Government employment.

·         Allows the state to provide scholarships and other aid from the State Government to the permanent residents. 

About Article 370

·         Adopted on in 1956, came in to force from 1957.

·         Parliament needs J&K Government’s approval for applying and amending all laws except defence, foreign affairs, finance, and communications.

·         The central government cannot declare emergency on grounds of internal disturbances or imminent danger unless approved by the state.

·         Allows the state of Jammu and Kashmir to make its constitution.

The Government of India under the leadership of Shri Narendra Modi and Shri Amit Shah marks this day a historic one. The Central Government scraps the Article 35A and Article 370 which grants the Indian state of Jammu and Kashmir a special status and also prevents the non-J&K residents from the rights and privileges in the state. It was a much-awaited move and will certainly help in keeping peace in the valley.
